With the amendment of Article 51 of the Commercial Register, it is no longer possible to allow everyone to inspect entrepreneurs' private addresses.

In brief:

The regulation makes it possible to shield the visiting address of an enterprise or legal entity in the commercial register. This is relevant when there is a threat, and it is therefore undesirable for the address to be accessible to everyone.

Article 51 paragraph 3 Hrb. regulates that a visiting address of an enterprise or legal entity recorded in the commercial register can be shielded if this is necessary for the safety of one or more persons. This also applies if the address in question is not a residential address. The applicant must substantiate that shielding is genuinely necessary. This can be done, for example, by demonstrating that a threat has been reported.

Article 51 paragraph 4 Hrb. regulates that people who, due to their profession, are exposed to probable threats, such as journalists, can also have their visiting address in the commercial register shielded preventively. For such shielding, the address must also be a residential address, and the enterprise in question must not be a capital company (BV or NV). The rules for preventive shielding are stricter because there is no established threat to justify the reduction in transparency. For preventive shielding, professional organizations must make agreements with the Chamber of Commerce about the profession-related shielding criteria. In this way, professional organizations play a role in assessing the requests.

For both regulations, the shielding must be meaningful. This means that the address to be shielded must not be traceable in various places.
