Our Terms and Conditions

We would like to clarify the Terms and Conditions so that you, the customer, know where you stand.

Terms and Conditions Postadres.nl

1. Terms
  1. Postadres.nl is a trading company of Luc Hoving Verhuur, located in Eindhoven, registered with the Chamber of Commerce under number: 17128612.
  2. Customer: The natural or legal person with whom Postadres.nl has a written or verbal agreement to offer and provide the Service in the name and for the account and risk of this natural or legal person. The General Terms and Conditions apply without prejudice to the Customer.
  3. Service: Offering the use of the Postadres.nl packages: ZZP (formerly Basic), Plus and All in One, telephone service and telephone forwarding service via the Internet, by telephone or in writing and offering the rental and use of the conference rooms or meeting rooms.
2. General
  1. These Terms and Conditions apply to all offers and agreements of Postadres.nl and Zakenadres.nl
  2. Agreements with personnel of Postadres.nl do not bind Postadres.nl unless confirmed in writing by it.
  3. Postadres.nl and Zakenadres.nl is a mail service and rental office formula of Luc Hoving Verhuur and gives the Client the right to use the accommodation on a temporary basis as an office for a fee t.e. during a previously agreed period and fee.
  4. Use of the office for retail purposes, with frequent walk-in shoppers, is not permitted.
  5. Postadres.nl provides the Customer with a telephone number in accordance with the agreed contract. Telephone calls and messages will be handled in accordance with the instructions provided by the Customer and the Customer will be responsible for all resulting forwarding and service charges. This agreement applies only to those seeking to contract for telephone service. Postadres.nl is under no obligation to provide this service to other(s) and is not responsible for messages or calls received for others. The businesses of Postadres.nl are accessible during normal business hours unless other arrangements have been made.
  6. The period of validity of the Customer's contract entered into is equal to the period stipulated therein. The notice period is at least one month. Interim change to another package is possible. Changing to a more extensive package can be done within 24 hours. Changing to a less extensive package is only possible after the expiration of the current contract and with a minimum notice period of 1 month.
  7. The Customer authorizes Postadres.nl to accept mail, parcels and registered items, all risks and additional costs shall be borne by the Customer.
  8. Postadres.nl will not take delivery of items that weigh more than 4.5 kg, measure more than 45 cm in length, width or height, or are bulkier than 0.03 m3 or contain dangerous, live or perishable goods, and has the right, at its discretion, to return uncollected items or to refuse to take delivery of items presented in quantities it deems unreasonable or unlawful. Postadres.nl makes no warranty, nor assumes responsibility, for the services mentioned in this document.
  9. The Customer assures that it will not use the rights granted to it under this Agreement for any improper, illegal, immoral or defamatory purposes and that it will not in any way discredit Postadres.nl . The Customer shall not use or combine the name Postadres.nl, in whole or in part, in any way whatsoever in the context of commercial activities. Postadres.nl reserves the right to cooperate with an official investigative body if necessary in connection with allegations of improper conduct brought against a Customer.
  10. The Customer indemnifies Postadres.nl and its staff against any liability in relation to the contents of mail items and parcels. The Customer is prohibited from sending or having sent via Postadres.nl the following substances/products with the following properties:
    * Flammable
    * Explosive
    * Fireworks
    * Narcotics
    * Cash or money orders
    * Chemically irritating (liquid) substances
    * And illegal products and substances in accordance with European regulations
    Postadres.nl will hold the Customer fully liable for any direct and indirect damages if the above products are nevertheless shipped via Postadres.nl .
  11. Postadres.nl reserves the right to refuse entry to the premises to persons under the influence of alcohol, drugs or other narcotics.
3. Application/registration fees.
  1. Application is made through the registration procedure.
  2. The registration procedure involves:
    * Submitting a registration from the Chamber of Commerce, if the company is already registered there.
    * Submitting a copy of an identification document.
    * Payment of the registration or connection fee.
    * The acceptance of the General Terms and Conditions of Sale by the Customer.
    * A confirmation from Postal Address about the contract entered into.
4. Delivery/Payment.
  1. All prices and rates are exclusive of sales tax (VAT) and other levies imposed by the government.
  2. All payments must be made by direct debit within five calendar days of the invoice date. Connection or registration fees must be paid in advance.
  3. Unless otherwise agreed, billing for monthly amounts will be done per month in advance. All services rendered will be listed on the bill. If an agreement is entered into for a specific consecutive period, billing will be done prior to that period.
  4. If Customer has not paid within 14 days of invoice date, Postadres.nl is entitled to suspend its services and return mail to sender until payment is received.
  5. If the Customer defaults, Postadres.nl may suspend the service for the Customer and Postadres.nl is entitled to increase the amount due with collection, court and other collection costs, with a minimum of 15% of the principal amount, to be increased with the legal interest. If the Customer is in default of any obligation under this agreement, Postadres.nl without prejudice to the foregoing, shall have the right to terminate the agreement immediately and without judicial agreement.
5. Additional costs
  1. The fee for forwarding mail and packages is the actual postage and shipping costs incurred (handling charges). All mail will be forwarded, including advertising, unless otherwise agreed.
  2. Reimbursement of connection charges when transferring the phone and/or fax.
  3. The scanning service fee according to the agreed contract.
  4. Any parts or other services not listed here that are used will be charged.
6. Liability
  1. Postadres.nl can never be held liable by the Customer or third parties for damage, including immaterial damage and trading loss resulting from delays, leaks, erroneous reporting, strikes, delays, technical failures or dereliction of duty by an employee, manager or fiduciary of Postadres.nl.
  2. The Customer must treat with care all parts of the business center, equipment, Installations and fixtures used. Parts thereof may not be altered. The Customer is liable for all damage caused by the Customer or visitors received by the Customer, both in the building and on the premises of Postadres.nl If the Customer leaves property in the Business Center, we may dispose of it in the manner we see fit, without owing you any accountability or any portion of the sale proceeds.
  3. Postadres.nl shall never be liable for the alienation of any data or materials provided by you.
  4. The Customer will not cause a nuisance to other users of Postadres.nl.
7. Application/amendment of general terms and conditions
  1. Postadres.nl reserves the right to propose an amendment to these terms and conditions at any time. The notice of amendment will be addressed to the Customer, in writing or by e-mail.
    If the Customer does not accept this amendment, he must notify Postadres.nl, in writing, within three calendar weeks of the sending of the proposal. Failing this, it is assumed that the Customer has accepted the amendment to the terms and conditions.
  2. If the Customer does not agree to a proposed change in the terms and conditions, Postadres.nl will be able to terminate the agreement.
8. Duration and termination/Privacy statement.
  1. The agreement between Postadres.nl and the Customer is concluded by completing the registration procedure in which the Customer indicates acceptance of these terms and conditions as part of the agreement.
  2. The agreement between Postadres.nl and the Customer is entered into for a period of 3 calendar months with a tacit renewal for an indefinite period.
  3. The agreement between Postadres.nl and the Customer can be terminated after a period of 2 months plus a notice period of one calendar month following the current month. As a result, the agreement always ends at the end of a full calendar month.
  4. Termination must be in writing.
  5. Postadres.nl reserves the right to dissolve the agreement, without written notice, at all times without giving reasons.
  6. Postadres.nl reserves the right to terminate the agreement immediately if:
    * The personal or business details provided by the Customer are found to be incorrect, outdated or incomplete;
    * The Customer becomes insolvent, goes into liquidation or is no longer able to pay debts as they fall due;
    * The Customer fails to fulfill any of the obligations that he is unable to fulfill or has not been able to fulfill within fourteen days of our notice of default;
    * The conduct of The Customer, or the conduct of anyone at Postadres.nl 's Business Center with your consent or at your invitation, is unlawful, fraudulent. defamatory or incompatible with normal office use.
  7. If we terminate the Agreement for any of these reasons, the Customer must:
    * Provide a change of address within a period of fourteen calendar days;
    * Pay for additional services used by the Customer;
    * Pay the standard rate for the remainder of the period that the Agreement would have lasted if we had not terminated it or (whichever is longer) for a further period of three months, and indemnify us for all our costs and losses resulting from termination.
    * Upon termination of the agreement for any reason, the Customer is responsible for notifying all parties of the change of address. Mail sent to Postadres.nl after termination will be returned to the sender. Customers are responsible for ensuring that their address is registered with Postadres.nl and is no longer registered with Postadres.nl after termination of the agreement.
  8. Contract transfer:
    If a customer transfers/sells its business to another entity and thereby wishes to transfer the contract with Postadres.nl , the contract acquisition requires prior approval from Postadres.nl. For this purpose, the customer can request a "Contract Acquisition Request" form in advance and return it fully completed. Only after written approval from Postadres.nl can the contract be transferred. Postadres.nl reserves the right, without giving reasons, to refuse the contract takeover request.
9. Legal provisions

The Prevention of Money Laundering and Financing of Terrorism Act (WWFT).
Under WWFT, both Postadres.nl and its corporate clients have a number of obligations:

  1. The customer is required to identify himself at Postadres.nl with a legal means of identification.
  2. Postadres.nl is obliged to check and verify the identification for accuracy. Only after proven accuracy and proper verification can a contract be entered into with Postadres.nl .
    Accordingly:
    * The customer is obliged to provide the correct means of identification.
    * Only after Postadres.nl has established the correct identification and the results of the verification are accordingly is the agreement final.
    * The customer is responsible that his data at Postadres.nl and, if applicable, the Chamber of Commerce match and are and remain current. In case of discrepancy, Postadres.nl is obliged to report this to the Chamber of Commerce.
    * Upon termination of the agreement with Postadres.nl , the customer shall ensure that, if applicable, the address provided by Postadres.nl is deregistered from the Chamber of Commerce.
    * The customer is aware that Postadres.nl is obliged to report any observed unusual financial flows or transactions to the Financial Intelligence Unit Nederland. (FIU).
    * Postadres.nl reserves the right to terminate the agreement with immediate effect if identification data are subsequently found to be incorrect, data are not in accordance with those of the Chamber of Commerce or if there are unexplained financial transactions. In this case, the customer may not invoke any rights.
10. Data

The Customer agrees that Postadres.nl may process, disclose or transfer any personal data that Postadres.nl holds about or relating to the Customer on the condition that such information is used only in connection with the fulfillment of the Customer's obligations under this Agreement or for review of work, fraud prevention and in the event of overdue payments. 11. Right of Withdrawal

The Customer has the right to cancel the agreement up to 14 days after the effective date without giving any reason. However, the Customer will be invoiced for the services provided up to that time. The registration and subscription fees will be credited to the Customer. To exercise this right, please contact us at info@postadres.nl. We will then refund the order amount due within 14 days of notification of your return.
